1. About TrafficJam

TrafficJam™ is a real-time, location-based chat application operated by TrafficJam LLC, a Mississippi limited liability company. The app allows drivers stuck in traffic to communicate with other nearby drivers in the same traffic jam. All messages are ephemeral and automatically deleted when the jam clears or after 30 minutes, whichever comes first.

2. Eligibility

You must be at least 18 years of age and hold a valid driver's license to use TrafficJam. By using the app, you represent and warrant that you meet these requirements. TrafficJam is not intended for use by anyone under the age of 18. If we become aware that a user is under 18, we will take steps to remove their access and any associated data.

3. Account and Identity

TrafficJam does not require you to create a traditional account. You choose a nickname when you first open the app. You are not required to use your real name. Your nickname is stored locally on your device and is not linked to any personal identifying information such as your email address, phone number, or real name. You are responsible for any activity that occurs under your nickname during your use of the app.

4. Subscriptions and Payment

TrafficJam is available as a paid subscription. By subscribing, you agree to the following terms:

• The subscription is currently offered at $5.99 USD per year with an optional 7-day free trial period for new subscribers.
• Pricing may change in the future. Any price changes will apply at the next renewal period and will not affect the current billing cycle.
• All payments are processed through the Apple App Store or Google Play Store, depending on your device. TrafficJam LLC does not directly collect or store your payment information.
• Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
• You may cancel your subscription at any time through your device's App Store or Google Play settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.
• Free trial eligibility is determined by Apple or Google and is limited to one trial per user per platform.
• Refund requests are handled by Apple or Google according to their respective refund policies.

Safety features, including the SOS button and emergency dialing, are always free and do not require a subscription.

5. Acceptable Use

You agree to use TrafficJam only for its intended purpose: communicating with other drivers about traffic conditions, road hazards, alternate routes, and related information. You agree not to:

• Post content that is threatening, harassing, abusive, defamatory, obscene, or otherwise objectionable
• Post content that promotes violence, hatred, or discrimination against any individual or group
• Post content involving the sexual exploitation or abuse of minors
• Impersonate another person or misrepresent your affiliation with any person or entity
• Spam, solicit, advertise, or promote commercial products or services
• Share personal information of others without their consent
• Attempt to interfere with, disrupt, or compromise the integrity of the app, its servers, or its network
• Use the app while operating a vehicle in a manner that is unsafe or in violation of applicable traffic laws
• Submit false jam reports, manipulate severity ratings, or abuse the voting system
• Attempt to reverse engineer, decompile, or extract the source code of the app
• Use the app for any purpose that is illegal under applicable local, state, national, or international law

6. User-Generated Content

All messages, jam reports, severity ratings, route suggestions, and votes submitted through TrafficJam are considered user-generated content. By submitting content through the app, you acknowledge and agree that:

• You are solely responsible for the content you submit
• TrafficJam LLC does not pre-screen or actively monitor user-generated content but reserves the right to review reported content and take action
• All messages are ephemeral and are automatically deleted when a jam clears or after 30 minutes
• TrafficJam LLC is not liable for any content posted by users of the app
• You grant TrafficJam LLC a non-exclusive, royalty-free, worldwide license to display your submitted content to other users of the app for the duration that the content exists (until the jam clears)

7. Content Moderation and Enforcement

TrafficJam LLC reserves the right, but is not obligated, to:

• Remove any content that violates these Terms of Service or our Community Guidelines
• Block or restrict any user who violates these terms, without prior notice
• Report illegal content or activity to law enforcement authorities
• Report content involving child sexual abuse or exploitation to the National Center for Missing & Exploited Children (NCMEC) and relevant authorities
• Cooperate with law enforcement investigations when required by law or when we believe in good faith that cooperation is necessary to protect the safety of our users or the public

Users may report inappropriate content and block other users using the in-app reporting and blocking features. When you block a user, their messages are hidden from your view on your device. Blocking is silent (the blocked user is not notified) and remains in effect until you unblock that user from your Blocked Users list.

8. Location Data and Driving Safety

TrafficJam requires access to your device's GPS location to function. Location data is used to identify nearby traffic jams and verify your proximity to a jam. By using the app, you consent to the collection and use of your location data as described in our Privacy Policy.

Important: TrafficJam is designed to be used by vehicle occupants, including passengers. If you are the driver, you are solely responsible for operating your vehicle safely and in compliance with all applicable traffic laws. TrafficJam LLC does not encourage, condone, or authorize the use of a mobile device while actively driving. Voice input and read-aloud features are provided to support hands-free use, but you must always prioritize safe driving. TrafficJam LLC is not responsible for any accidents, injuries, or violations of traffic laws that occur while using the app.

9. SOS and Emergency Features

TrafficJam includes a one-tap SOS feature that shares your GPS coordinates with nearby drivers in the jam and provides a direct link to dial emergency services (911 in the United States). This feature is provided as a convenience and does not replace calling emergency services directly. TrafficJam LLC does not automatically contact emergency services on your behalf. TrafficJam LLC makes no guarantee regarding the response time, availability, or accuracy of emergency services. Safety features are always free and do not require an active subscription.

10. Disclaimers

TrafficJam is provided on an "as is" and "as available" basis. TrafficJam LLC makes no warranties, express or implied, regarding the app, including but not limited to:

• The accuracy, completeness, or reliability of any information provided by users, including jam reports, severity ratings, wait times, alternate route suggestions, or any other user-generated content
• The availability, continuity, or error-free operation of the app
• The app's fitness for any particular purpose

TrafficJam relies entirely on user-submitted data. Traffic conditions, road hazards, route suggestions, and wait times are reported by individual users and are not independently verified by TrafficJam LLC. You should always exercise your own judgment when making driving decisions and should not rely solely on information provided through the app.

11. Limitation of Liability

To the maximum extent permitted by applicable law, TrafficJam LLC, its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the app. This includes, without limitation, damages for personal injury, property damage, loss of data, loss of revenue, or any other damages arising from:

• Your use of or inability to use the app
• Any content posted by other users
• Any reliance on information provided through the app, including traffic reports, route suggestions, and wait times
• Any action taken or not taken based on information received through the app
• Any unauthorized access to or alteration of your data

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability exceed the amount you have paid to TrafficJam LLC in the twelve (12) months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless TrafficJam LLC, its officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or related to your use of the app, your violation of these Terms of Service, or your violation of any applicable law.

13. Intellectual Property

TrafficJam™, the TrafficJam logo, "Chat in the Crawl," and all associated visual designs, trademarks, and content created by TrafficJam LLC are the property of TrafficJam LLC. You may not copy, modify, distribute, sell, or lease any part of the app or its content without prior written permission from TrafficJam LLC. You may not use the TrafficJam name, logo, or branding for any purpose without prior written consent.

14. Third-Party Services

TrafficJam uses the following third-party services to operate. Your use of the app is also subject to the terms and policies of these providers:

• Google Firebase: Real-time database and infrastructure
• Google Maps: Map display and location services
• RevenueCat: Subscription management
• Apple App Store / Google Play Store: App distribution and payment processing

TrafficJam LLC is not responsible for the availability, performance, or policies of third-party services.

15. Termination

TrafficJam LLC reserves the right to restrict, suspend, or terminate your access to the app at any time, with or without notice, for any reason, including but not limited to a violation of these Terms of Service. You may stop using the app at any time. If you have an active subscription, cancellation of the subscription is handled through your device's App Store or Google Play settings.

16. Changes to These Terms

TrafficJam LLC may update these Terms of Service from time to time. When we make changes, we will update the effective date at the top of this page. Your continued use of the app after any changes constitutes your acceptance of the updated terms. We encourage you to review these terms periodically.

17. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Mississippi, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these terms or your use of the app shall be resolved in the courts of the State of Mississippi, and you consent to the personal jurisdiction of such courts.

18. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms of Service, together with our Privacy Policy and Child Safety Standards, constitute the entire agreement between you and TrafficJam LLC regarding your use of the app.
